Terms of Service

These terms govern your use of products provided by Gallium Technologies Pty Ltd (‘Gallium Technologies’, ‘we’, ‘us’, ‘our’). By installing or using any of our Google Workspace add-ons, you agree to these terms.

Where a product page is marked as planned or pre-launch, that page describes intended functionality only. These terms apply when you install or use a live Gallium product.

1. Description of service

Gallium Technologies provides Google Workspace add-ons that extend the functionality of Google Forms and Google Sheets. Each product does one thing:

• FormChime sends customised email notifications when a Google Form is submitted.
• ApproveKit adds approval workflows to Google Forms.
• HeyDB translates natural language questions into SQL queries for Google Sheets.

Our add-ons run on Google’s infrastructure as Apps Script projects. We do not host or process your data on our own servers.

2. User obligations

You agree to:

• Use the products in compliance with Google’s Terms of Service and Workspace Marketplace Terms.
• Not reverse-engineer, decompile, or attempt to extract the source code of any product.
• Not circumvent licence validation or usage limits.
• Not use the products for any unlawful purpose.

3. Account and access

You access our products through your Google account. We do not create separate accounts. Your Google account permissions and your organisation’s Google Workspace policies govern who can install and use our add-ons.

4. Pricing and payment

Free tier

Each product includes a free tier with usage limits described on the product page. The free tier is available indefinitely. It is not a trial.

Premium features

Premium features may be available via paid licences. Pricing shown on product pages is listed in US dollars (USD). For products that are not yet launched, pricing is provisional until the billing model is finalised.

Cancellation

You may cancel a premium licence at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.

5. Intellectual property

Gallium Technologies retains all rights, title, and interest in the products, including all software, designs, and documentation. You retain all rights to your data. We claim no ownership of any data processed by our products.

6. Data handling

Our handling of your data is governed by the privacy policy specific to each product:

• FormChime Privacy Policy
• ApproveKit Privacy Policy
• HeyDB Privacy Policy

In summary: we access only what is needed, store configuration in your Google account, do not store your data on our servers, and never sell or share your data.

7. Limitation of liability

To the maximum extent permitted by law, Gallium Technologies’ total liability for any claim arising from or related to the products is limited to the amount you paid for the product in the 12 months preceding the claim, or $100 USD, whichever is greater.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunity.

8. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation which cannot lawfully be excluded or limited. This includes the consumer guarantees under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2).

If the Australian Consumer Law applies to you as a consumer, our liability for failure to comply with a consumer guarantee is limited to (at our election):

• Supplying the services again, or
• Paying the cost of having the services supplied again.

9. International users

If you are located outside Australia, nothing in these terms affects any mandatory consumer protection or privacy rights you hold under the laws of your jurisdiction that cannot be excluded by contract. We acknowledge that users in the European Union, United Kingdom, United States, Canada, and other jurisdictions may hold additional rights under local legislation, including the GDPR, CCPA/CPRA, and PIPEDA. 10. Service availability

We do not guarantee uninterrupted service. Our products depend on Google’s infrastructure, and downtime may occur due to Google outages, maintenance, or changes to Google’s APIs. We will make reasonable efforts to notify users of planned maintenance.

11. Termination

Either party may terminate these terms at any time.

• You can terminate by uninstalling the product from the Google Workspace Marketplace.
• We may terminate or suspend access if you violate these terms, if required by law, or if Google discontinues the APIs our products depend on.

On termination, your configuration data stored in Google’s PropertiesService is removed when you uninstall the add-on. We do not retain any user data.

12. Changes to these terms

We may update these terms from time to time. When we make material changes, we will:

• Update the ‘Last updated’ date at the top of this page.
• Notify active users through the contact method available for the relevant live product where material notice is required.

Continued use of the products after the effective date constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of the State of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any dispute arising from these terms, subject to any mandatory local consumer protection or privacy laws that apply to you in your jurisdiction.
